These terms of service (hereinafter referred to as the "API Terms") establish the conditions for using the Listee API (hereinafter referred to as the "API") provided by GEN Ltd. (hereinafter referred to as the "Company"). Developers who use the API (hereinafter referred to as "Developers") must agree to these API Terms before using the API.
1.1 These API Terms establish the conditions for using the API provided by the Company.
1.2 Developers must agree to all provisions of these API Terms and the Company's Terms of Use (hereinafter referred to as the "Basic Terms") before using the API.
1.3 In the event of any conflict or inconsistency between these API Terms and the Basic Terms, these API Terms shall take precedence with respect to the use of the API.
2.1 API Key Management Responsibility: Developers are fully responsible for the secure management of their issued API keys. This includes key storage, access restrictions, and regular key rotation.
2.2 Obligation in Case of Leakage: If an API key is suspected of being leaked or misused, the Developer must immediately notify the Company and invalidate the relevant key.
2.3 Responsibility for Unauthorized Use: All API calls made using a Developer's API key, even if resulting from unauthorized access, are in principle the responsibility of the Developer. However, this shall not apply in cases where the leakage is due to the Company's negligence.
2.4 Incurrence of Fees: All paid API calls made using an API key will be charged to the Developer's account. Charges resulting from unauthorized use of the key are, in principle, the Developer's responsibility in accordance with section 2.3.
2.5 Security Best Practices: Developers shall follow these security best practices:
a) Not embedding API keys directly in source code
b) Not storing keys in version control systems (such as Git)
c) Setting up keys as environment variables
d) Implementing IP address restrictions where possible in production environments
3.1 Rate Limits: The Company may impose request limits to ensure stable operation of the API. Developers must comply with these limitations.
3.2 Prohibited Actions: Developers shall not use the API to:
a) Infringe upon the rights of the Company or third parties
b) Violate laws or public order and morals
c) Place excessive load on the service
d) Compromise security
e) Resell or redistribute the API
3.3 Usage Purpose Restrictions: Developers shall not use the API for purposes other than those permitted by the Company.
4.1 User Data Protection: Developers must appropriately protect user data acquired through the API and comply with all applicable privacy laws and regulations.
4.2 Data Retention: Developers must adhere to the Company's policies regarding the retention of data acquired through the API.
5.1 API Changes: The Company reserves the right to change the specifications or functionality of the API at any time. The Company will provide advance notice of significant changes when possible.
5.2 Suspension of Use: The Company may suspend or restrict access to the API without prior notice if the Developer violates these API Terms or if the Company determines that their use adversely affects the Company's services or users.
5.3 Service Termination: The Company reserves the right to terminate all or part of the API service at any time. The Company will provide advance notice of service termination when possible.
6.1 Disclaimer of Warranty: The API is provided "as is," and the Company makes no warranties regarding the functionality, reliability, availability, or fitness for a particular purpose of the API.
6.2 Limitation of Liability: The Company shall not be liable for any damages (including direct, indirect, incidental, consequential, special, or punitive damages) arising from the use or inability to use the API.
7.1 Entire Agreement: These API Terms and the Basic Terms constitute the complete agreement between the Developer and the Company regarding the use of the API.
7.2 Governing Law: The interpretation and application of these API Terms shall be governed by Japanese law.
7.3 Dispute Resolution: Any disputes related to these API Terms shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the location of the Company's headquarters.
